Introduction

As a member of the Canon family of companies, Canon U.S.A., Inc. ("Canon U.S.A.," “we,” “our” or “us”) respects your concerns about privacy and values its relationship with you. This A-Send Privacy Policy for California B2B Users (“Privacy Policy”) is intended to inform you of the types of information the Authorized Send Software (“A-Send” or the “Software”) collects and how that information will be used. The Software retains your information as required to permit the Software to operate.

Please read this Privacy Policy carefully, because by using the Software, you are acknowledging that you have read and understand the terms of this Privacy Policy, and consent to the manner in which the Software collects and uses the information described herein.

Canon U.S.A. is the licensor of A-Send– a serverless Multifunctional Embedded Application Platform (“MEAP”) application designed to allow authorized users to print from their folder structure directly at the A-Send interface, and to process and route scan workflows to single or multiple destinations from supported Canon devices.

The Software is designed for business use by business users residing and located in the United States.

Information collected by the Software is not automatically or passively transmitted to Canon U.S.A. for collection, processing or storage.

Our Role

When your organization provides you with use of the Software: 1) we act as a service provider to your organization, 2) our processing of information is governed by a contract between your organization and Canon U.S.A., and 3) we process information at your organization’s direction. In the event of a conflict between this Privacy Policy and the terms of any contract between your organization and Canon U.S.A., the terms of the contract will control.

If you are an end user of the Software, your use of the Software and any personal information collected in connection with its use, is subject to your organization's privacy and other policies, if any. Canon U.S.A. is not responsible for the privacy or security practices of your organization, which may differ from those set forth in this Privacy Policy. In the event of any inconsistency or conflict as to the processing of your information under this Privacy Policy and your organization’s policies, the provisions of this Privacy Policy control. If you have any questions related to the personal information that your organization has authorized the Software to collect, you should direct your inquiries, including any requests to exercise your data privacy rights, to your organization’s administrator.

The Software may collect personal information in order for the Software to operate and when information is collected automatically from your interactions with the Software.

Personal Information Provided by You

When you access or use the Software, the types of personal information that the Software may collect from you include personal contact information, such as your name and email address.

Usage Information Collected by the Software

Whenever you use or interact with the Software, the Software may use a variety of technologies that automatically or passively collect information about how the Software is accessed and used. Usage Information may include report information, such as user names, number of pages and documents processed, page color, page resolution, scanning destinations, file types, and file names. Usage information may also include log details, such as the names of users who log into the Software and Software error details. Your organization may use log details for auditing purposes. Your organization may also voluntarily share log details with us for troubleshooting purposes. If your organization discloses log details to us, it does so pursuant to a contract between your organization and Canon U.S.A.

Personal Information the Software Collects from Other Companies

When you access the Software using a third-party cloud storage service, the Software may collect your cloud storage service credentials from that other company.

Personal Information

The Software may store, analyze, combine, and otherwise use the personal information that it collects, either directly or indirectly, to:

  • Enable the operation of the Software; and
  • Enable your organization to generate report information and log details related to the use of the Software.

The Software is not intended for use by anyone under the age of 13. The Software does not knowingly collect personal information from anyone under 18. If you discover that the Software inadvertently collected personal information from anyone under 18, please consult your organization’s administrator.

Collection, Disclosure, and Sale or Sharing of Personal Information

In the last twelve (12) months, we have not collected, disclosed for a business purpose, or sold/shared any personal information collected by the Software.

Sensitive Personal Information

Sensitive personal information is not collected by the Software or by us.

California B2B Users

We do not collect, and therefore we do not sell or share, your personal information.

Personal Information of Children Under Age 18

We do not collect, and therefore we do not sell or share, personal information of individuals we know to be less than 18 years of age.

Retention of Your Personal Information

The Software retains your personal information for as long as it is reasonably necessary for the purposes for which the information was collected. However, some or all of your personal information may be deleted sooner if logs or report files containing your personal information are automatically deleted by the Software due to the logs or report files exceeding their size limitations, or if your organization’s administrator deletes your personal information.

Sources of Your Personal Information

As described above in the “The Information the Software Collects and How the Information is Collected” section, the Software collects information directly from you and automatically when you access or use the Software.

Purposes for Collecting Your Personal Information

The Software collects or discloses personal information about you for the business purposes further described in the “How the Software Uses the Information It Collects” section above.

Your California Privacy Rights

If you are a California resident, you have the right, under the California Privacy Rights Act (“CPRA”), subject to certain exemptions, to:

  • Access and receive, up to twice every 12 months, a portable copy of the personal information that we have collected about you in the last 12 months;
  • Know specifically:
    • The categories and specific pieces of personal information we have collected about you;
    • The categories of the sources of the personal information;
    • The purposes for which your personal information is collected and used;
    • The categories of personal information that the business disclosed for a business purpose, and for each category identified, the categories of third parties to whom that particular category of personal information was disclosed; and
    • The categories of personal information that the business sold or shared, and for each category identified, the categories of third parties to whom that particular category of personal information was sold or shared;
  • Correct inaccuracies in your personal information;
  • Delete your personal information;
  • Limit the use of your sensitive personal information;
  • Opt out of or object to having your personal information sold to, or shared with, third parties; and
  • Not be discriminated against by us for exercising any of these rights.

As mentioned above, personal information collected by the Software is not automatically or passively transmitted to Canon U.S.A. for collection, processing or storage.

Exercising Your Rights

If an organization provides you with use of the Software, your use of the Software is subject to your organization's privacy and other policies, if any. You should direct your privacy inquiries, including any requests to exercise your data privacy rights, or any appeal of your organization’s decision to not honor a privacy request, to your organization.

Authorized Agents

If you are a resident of California and would like to designate an authorized agent to submit certain requests on your behalf, you should direct your request to the organization that provided you with use of the Software. If you are an authorized agent of a California resident and would like to submit a request on behalf of the California resident, you should direct your request to the organization that provided the California resident with use of the Software.

California “Shine the Light” Disclosure

California Civil Code Section 1798.83 gives California residents the right to request, from a business with whom the California resident has an established business relationship, certain information with respect to the types of personal information the business discloses to third parties for direct marketing purposes by such third party, and the identities of the third parties with whom the business has disclosed such information during the immediately preceding year. Canon USA does not collect your personal information and therefore does not disclose your personal information to third parties for direct marketing purposes by such third parties.

When you submit information through the Software, you should be aware that your information is transmitted across multiple computer systems on the Internet. Although the Software uses reasonable and appropriate physical, technical, and organizational security measures to protect your information from accidental loss and from unauthorized access, use, alteration and disclosure, no method of transmitting or storing electronic data on the Internet is ever completely secure, and we do not guarantee the security of such information at any time.

While Canon U.S.A. is a U.S. company, the Software may collect, and you may provide the Software with information wherever you are located. By using the Software, or providing the Software with any information, you understand that the collection, processing, maintenance, transfer and storage of such information will occur in locations specified in your organization’s privacy and other policies, if any. Canon U.S.A. is not responsible for the privacy or security practices of your organization, which may differ from those set forth in this Privacy Policy.

We reserve the right to modify this Privacy Policy at any time at our sole discretion. If we modify this Privacy Policy, we will post the revised policy on the Software, with an updated revision date. Changes will be effective immediately upon the posting of the revised Privacy Policy on the Software. In the event we make material changes to this Privacy Policy, we will notify you through the Software prior to the changes taking effect. Please note that if you do not agree to the modified Privacy Policy, you may not use the Software. Your continued use of the Software following the posting of the changes or any applicable notice period will mean that you accept those changes.
